U.S. Warns Nigerians Over Visa Fraud: Offenders Face Lifetime Ban and Criminal Charges

In a firm declaration of its ongoing immigration clampdown, the United States government has issued a stern warning to Nigerians against engaging in visa fraud, stating that violators will face lifetime bans and possible prosecution.

The warning, delivered via the official X (formerly Twitter) handle of the U.S. Mission in Nigeria, underscores Washington’s growing intolerance for visa-related offenses and illegal immigration activities. The Mission emphasized that those who forge documents, commit immigration-related fraud, or help smuggle and harbour illegal migrants into the U.S. will be prosecuted under criminal law and permanently barred from entering the country.

“U.S. government inter-agency efforts combat fraud and will end illegal immigration. Those who commit visa fraud will be banned from the United States for life,” the statement read. It added, “A nation without borders is not a nation. We will pursue criminal charges against those who engage in visa fraud and those who bring in and harbour illegal aliens.”

This declaration follows the recent controversy surrounding the U.S. government’s decision to reduce Nigerian visa durations to three months with single-entry validity. However, tensions seemed to ease slightly after the U.S. Embassy in Nigeria lauded the Nigerian government for its proactive engagement on the issue.

Clarification on Visa Validity and U.S. Entry Rules

In a related advisory, the U.S. Embassy clarified that a visa’s expiration date does not determine how long a visitor can stay in the United States. Instead, that decision is made by Customs and Border Protection (CBP) officers at the port of entry.

“The length of time an international visitor is allowed to stay in the United States is determined by the CBP officer upon arrival—not by your visa expiration date,” the Embassy explained. “Travelers must monitor their I-94 form to avoid overstays.”

Travelers can check their “Admit Until Date” online via the I-94 website (i94.cbp.dhs.gov), the embassy added, warning that overstaying—even inadvertently—could result in severe immigration consequences.

Nigeria’s Immigration Crackdown and Amnesty Window

Coinciding with Washington’s hardline stance, the Nigerian government has also launched a broad immigration reform, introducing a daily surcharge for foreigners who overstay their visas. According to Nigeria’s Interior Minister, Olubunmi Tunji-Ojo, a $15 fine will be imposed for each day a visa is overstayed, effective from August 1, 2025.

To aid compliance, Nigeria has launched an online amnesty portal that allows foreign nationals to regularise their stay until July 31, 2025, without incurring penalties. After this grace period, overstays of six months or more will result in a five-year re-entry ban, while those exceeding one year will face a ten-year ban.

In a separate notice to its citizens in Nigeria, the U.S. Embassy in Abuja urged American nationals to take advantage of the amnesty window and align with Nigeria’s immigration directives to avoid heavy penalties.

“The US Embassy in Abuja informs U.S. citizens that effective August 1, 2025, the Nigerian Federal Government will begin imposing strict penalties on foreigners who have overstayed their visas,” the statement read. “U.S. citizens who have overstayed their visas in Nigeria are strongly encouraged to use the amnesty portal before July 31, 2025.”

Streamlined Compliance via New Portal

The new Nigerian immigration portal simplifies the process for foreigners to regularise their immigration status. Holders of expired visa-on-arrival permits, single-entry visas, or expired expatriate residence cards can now submit online applications, upload required documentation, and obtain clearance—all without visiting a physical immigration office.

The U.S. Embassy described the platform as an “accessible and efficient solution” to help foreigners avoid in-person queues, additional fees, and legal hurdles.

With immigration enforcement tightening on both sides, travelers are urged to stay vigilant, adhere to visa regulations, and avoid any actions that may jeopardize their international mobility or legal standing.
