 In this exclusive interview with TopFlyers magazine, Charles Dickson Usen, an internationally trained attorney, shares insights into his professional journey as both a legal practitioner and a Chartered Tax Practitioner. He earned a Bachelor of Laws from the University of Uyo in Nigeria and ranked in the top 5% at the Nigerian Law School. Furthering his expertise, he obtained a Master of Laws from the University of Illinois, Urbana-Champaign. Charles’s dual role reflects his dedication to both legal practice and specialized knowledge in tax law.

 

Educational background:

After completing my undergraduate studies, I obtained a Bachelor of Laws degree from the esteemed University of Uyo in Nigeria. Following this accomplishment, I pursued further academic advancement by enrolling at the Nigerian Law School, where I distinguished myself among a sizable cohort of over 5,000 students, ranking in the top 5% of my class. Eager to expand my knowledge and expertise in corporate, commercial, and tax law, I embarked on a journey of higher education abroad, enrolling at the University of Illinois, Urbana-Champaign, in the United States. There, I pursued a rigorous program and earned a Master of Laws degree, specializing in Corporate, Commercial Law, and Trade. This experience provided me with invaluable insights and a comprehensive understanding of complex legal frameworks in these areas.

In addition to my academic pursuits, I have also obtained professional certifications to further enhance my credentials and proficiency in law and tax. I am proud to be recognized as a Chartered Tax Practitioner by the Chartered Institute of Taxation of Nigeria, a designation that reflects my expertise in navigating the intricate landscape of tax law. Furthermore, I have earned certification as a Corporate Governance Professional from the Institute of Chartered Secretaries and Administrators of Nigeria, demonstrating my commitment to upholding the highest standards of ethical conduct and corporate accountability. I have equally earned recognition from respectable institutions for my work. Collectively, my educational achievements and professional certifications underscore my dedication to continuous learning and professional development.

How do you keep yourself updated with the dynamic legal landscape, particularly in your specialized area of tax?

Keeping up with the ever-evolving legal framework, especially within the intricate domain of tax law, demands a continuous commitment to staying informed. With the ever-changing nature of tax regulations, it is necessary for me to remain updated on the latest developments to ensure a comprehensive understanding of their implications, not only for my clients but also for the broader community. This entails a multifaceted approach, including diligent reading, active participation in training sessions, and pursuing certification courses tailored to my specialized field.

Over the past few months, for instance, I have dedicated significant time to attending various tax-focused training programs, aiming to deepen my understanding of the nuances of tax practice within the United States. These engagements have provided invaluable insights into emerging trends, legislative changes, and judicial interpretations, equipping me with the expertise needed to navigate complex tax scenarios effectively. I firmly believe that the pursuit of knowledge is an ongoing journey, characterized by continuous learning and adaptation. In a landscape where regulations are in a constant state of change, maintaining relevance in the tax professional sphere necessitates a proactive approach to knowledge acquisition. By remaining vigilant and proactive in updating my skill set, I strive to uphold the highest standards of expertise and service delivery for the benefit of my clients and the wider community.

Transitioning from practicing tax law in Nigeria to the United States, what motivated your decision to relocate?

Transitioning from practicing tax law in Nigeria to the United States was motivated by several compelling factors, all of which contributed to my pursuit of professional advancement and personal growth in the field of taxation. Firstly, my academic journey has been marked by a relentless commitment to excellence, culminating in the attainment of a Bachelor of Laws degree from the University of Uyo and subsequent recognition as a top performer at the Nigerian Law School, where I ranked among the top 5% of my class. While my legal education in Nigeria provided me with a strong foundation in tax law principles, I recognized the value of gaining exposure to diverse tax regimes and perspectives. This recognition, coupled with a desire to deepen my expertise in tax law, prompted me to seek opportunities for further education abroad.

The decision to pursue a Master of Laws degree at the University of Illinois, Urbana-Champaign, with a concentration in Corporate, Commercial Law, and Trade, was driven by a keen interest in exploring the complexities of international tax frameworks and their practical applications. Moreover, the decision to relocate to the United States was motivated by a recognition of the vast opportunities available in the American tax landscape. With its reputation as a global leader in taxation and a diverse range of tax specialties, the United States offered an ideal environment for professional growth and advancement in tax law. By immersing myself in this dynamic tax environment, I aimed to broaden my expertise, expand my professional network, and gain exposure to innovative tax practices and methodologies. Furthermore, the decision to relocate was informed by a desire to leverage my expertise and credentials in new contexts and contribute meaningfully to the tax profession on an international scale. By embracing the challenge of adapting to a new tax jurisdiction, I sought to position myself as a versatile and resourceful tax practitioner capable of navigating complex tax landscapes with confidence and proficiency.

What key qualities do you believe differentiate exceptional lawyers from average ones?

I believe that the key qualities that differentiate an exceptional tax lawyer from an average one include deep knowledge of the law, integrity, hard work, teamwork, and an ongoing commitment to learning.

Can you recount a challenging experience from your legal career and how you navigated through it?

Early in my career as a tax practitioner, I encountered a particularly challenging case involving a client facing a complex tax audit. The audit revealed discrepancies in the client’s financial records, raising concerns about potential non-compliance with tax regulations. This situation demanded a combination of legal expertise, communication skills, and strategic thinking to navigate effectively.

Firstly, I examined the intricacies of the tax code relevant to the client’s situation, conducting thorough research and analysis to understand the root causes of the discrepancies. This involved reviewing relevant statutes, regulations, and case law to identify potential areas of concern and formulate a comprehensive strategy for addressing them. Next, I engaged in clear and transparent communication with the client, explaining the audit findings and potential implications in a manner that was both informative and reassuring. I emphasized the importance of cooperation and transparency throughout the audit process, instilling confidence in the client and fostering a collaborative partnership.

Drawing upon my problem-solving skills, I devised a multifaceted approach to resolving the issues identified during the audit. This included conducting a meticulous review of the client’s financial records, identifying and correcting errors, and implementing proactive measures to ensure compliance with tax regulations moving forward. When confronted with ethical dilemmas in my role as a tax practitioner, I adhere to a principled approach that prioritizes integrity, transparency, and the best interests of my clients. An example of this occurred when I encountered a situation where a client inadvertently omitted certain income sources from their tax returns, potentially leading to underpayment of taxes. In addressing this dilemma, I first conducted a thorough analysis of the relevant tax laws and regulations to understand the implications of the client’s oversight. I then engaged in open and honest communication with the client, explaining the situation and the potential consequences of non-compliance with tax regulations.

Drawing upon my ethical framework, I advised the client on the importance of rectifying the omission and fulfilling their legal obligations. Together, we developed a strategy to amend the tax returns, accurately reporting the omitted income and ensuring full compliance with tax laws. Throughout this process, I upheld the principles of integrity and professionalism, maintaining transparency with the client and demonstrating a steadfast commitment to ethical conduct. Additionally, I tailor my arguments to resonate with the specific concerns and perspectives of the audience, leveraging clear and persuasive communication to convey complex concepts in a compelling manner. By presenting a coherent and well-supported case grounded in legal principles and precedent, I strive to persuade judges or tax authorities of the validity of my client’s position while maintaining the highest standards of professionalism and integrity. This approach allows me to effectively advocate for my clients’ interests and achieve favorable outcomes in diverse legal settings.

Reflecting on your career, have you encountered situations where representing a client conflicted with your personal beliefs, and how did you manage it?

As a tax professional, I have encountered situations where representing a client conflicted with my personal beliefs. In such instances, I try to maintain professionalism and adhere to ethical standards while serving the client’s needs. To manage this conflict, I focus on the principles of objectivity and neutrality. My role is to provide accurate tax advice and representation, irrespective of my personal views. As such, I ensure that I fully understand the client’s situation and objectives so I can offer the best guidance within the bounds of the law. If there is a significant ethical dilemma, I may seek guidance from colleagues or consult with professional organizations to ensure that I handle the situation appropriately. Ultimately, my commitment is to serve my clients with integrity while upholding the standards of my profession.

Balancing meticulousness and tight deadlines in your casework can be demanding. How do you manage this?

Balancing meticulousness and tight deadlines in casework requires a strategic approach. Firstly, I prioritize tasks based on urgency and importance, breaking them down into manageable steps. Utilizing established processes and checklists helps me maintain thoroughness while staying organized. Efficient use of resources, such as software tools and research databases, streamlines tasks and ensures that I have access to relevant information. Additionally, clear communication with clients is essential. I set realistic expectations and provide regular updates on progress, negotiating deadlines if necessary. Remaining adaptable and flexible allows me to adjust priorities as needed to meet deadlines without compromising quality. By employing these strategies, I effectively manage the demands of casework while upholding meticulous standards.

What impact do you think COVID-19 has had on tax practice, and how do you integrate this knowledge into your practice?

As a tax practitioner in the United States, I have experienced firsthand the profound impact of COVID-19 on our profession. The pandemic has necessitated a rapid transition to remote work and virtual client interactions. Understanding this shift, I have embraced technology more deeply, integrating digital tools for seamless collaboration and communication with clients. Also, staying abreast of the evolving tax laws and relief measures emanating from COVID-19 has been paramount. I have dedicated myself to continuous education, ensuring that I am well-informed about the latest developments and their implications for my clients. By leveraging technology and staying updated on regulatory changes, I can provide timely and relevant guidance to clients navigating the complexities of their tax obligations during these unprecedented times. This approach ensures that my practice remains adaptable and responsive to the challenges posed by the pandemic, ultimately serving the needs of my clients effectively.

Considering future legal trends, what changes do you anticipate in your field, and how are you preparing for them?

Recent events in the United States, such as changes in tax policies under new administrations and ongoing legislative discussions, indicate potential shifts in the tax landscape. Anticipating future legal trends, I foresee increased scrutiny on tax compliance, potential revisions to tax rates, and continued emphasis on environmental and social responsibility in tax policy. To prepare for these changes, I stay vigilant in monitoring legislative developments and participate in professional networks to stay informed about emerging trends. Additionally, I prioritize ongoing education to deepen my understanding of evolving tax laws and regulations. Embracing technology remains crucial for efficiency and compliance, so I continue to invest in digital tools and training to enhance my practice’s capabilities. Furthermore, I proactively engage with clients to anticipate their evolving needs and provide strategic tax planning advice. By maintaining adaptability, staying informed, and fostering proactive client relationships, I ensure readiness to navigate future legal trends and effectively serve my clients in an ever-changing tax landscape.

What advice would you offer aspiring tax practitioners based on your experiences?

Based on my experiences, I would advise aspiring tax practitioners to prioritize continuous learning, staying updated on tax laws and regulations, and honing their analytical skills. They should also embrace opportunities for professional development, whether through formal education, certifications, or practical experience. Additionally, focus on developing strong communication abilities to effectively interact with clients and colleagues. Cultivate adaptability and resilience, as the tax landscape is constantly evolving. By building a solid foundation and staying proactive in their growth, they will be well-prepared for a successful career in tax practice.
