Federal Judge Halts Trump’s Executive Order on Birthright Citizenship, Declares It Unconstitutional

A federal judge in Seattle has issued a temporary block on former President Donald Trump’s executive order seeking to end birthright citizenship for children born in the United States to undocumented immigrants or temporary residents. The order, titled “Protecting the Meaning and Value of American Citizenship,” was slated to take effect on January 19 but has now been deemed “blatantly unconstitutional” by Judge John Coughenour.

The Controversial Order

Signed shortly after Trump assumed office as the 47th President of the United States, the executive order instructed government agencies to stop issuing citizenship documentation to babies born in the U.S. to parents without legal status. The move sparked immediate backlash, with immigration advocacy groups filing lawsuits challenging its legality. Several states, including Washington, stepped in to argue that the policy violated constitutional rights guaranteed under the Fourteenth Amendment.

Judge’s Scathing Remarks

During a brief hearing, Justice Department lawyer Brett Shumate attempted to defend the order, but Judge Coughenour cut him off, asking pointedly, “Is this order constitutional?” The judge dismissed the government’s argument, stating emphatically, “This is a blatantly unconstitutional order.”

Referring to historical legal failures to protect constitutional rights, Judge Coughenour added, “We look back in history and say, ‘Where were the judges, where were the lawyers?’ Frankly, I have difficulty finding that a member of the bar can state confidently that this is a constitutional order.”

Nationwide Block and Legal Ramifications

The ruling, which applies nationwide, temporarily halts the implementation of the executive order. Speaking to the press after the hearing, Washington Attorney General Nicholas Brown described the decision as “fairly obvious” and “a simple case of upholding the Constitution.” Brown expressed confidence that the ruling would withstand further legal challenges, noting that it represents the first step in what is likely to be a prolonged legal battle.

Next Steps

The Trump administration has yet to announce its next legal move following the ruling. However, legal experts predict that the case could eventually reach the Supreme Court, given its implications for immigration policy and constitutional interpretation.

For now, immigration advocates and legal professionals celebrate the decision as a significant victory in the fight to preserve birthright citizenship, a right enshrined in the Fourteenth Amendment of the U.S. Constitution.
