Georgia Judge Drops Three Charges in Trump Election Interference Case, but Indictment Stands

In a significant development in the Georgia election interference case, a state judge dismissed three of the charges in the indictment against former U.S. President Donald Trump and several co-defendants. The decision, made on Thursday by Fulton County Superior Court Judge Scott McAfee, reduces the number of charges Trump faces to eight felony counts.

Two of the three dismissed charges directly involved Trump, who, along with others, has been accused of attempting to overturn the results of the 2020 presidential election in Georgia. The charges related to the filing of fake elector certificates, falsely claiming that Trump had won the state, even though President Joe Biden secured Georgia by approximately 12,000 votes.

Judge McAfee explained that the dismissed charges were connected to federal crimes, and under the U.S. Constitution’s Supremacy Clause, state prosecutors do not have the authority to pursue such cases. “The Supremacy Clause declares that state law must yield to federal law when the two conflict,” McAfee stated in his ruling. As a result, the charges of filing false documents and conspiring to do so were dropped.

Despite this partial dismissal, McAfee rejected a broader request to quash the entire indictment, which still accuses Trump and his allies of racketeering and other offenses. The case, brought by Fulton County District Attorney Fani Willis, has been temporarily halted by an appeals court, as Trump and his co-defendants seek to disqualify Willis due to a past controversy involving a special prosecutor she hired. Arguments related to this disqualification are set to be heard by the Georgia Court of Appeals in December.

Although the two charges against Trump have been dismissed, they will not be officially dropped until the appeals process is completed. In the meantime, the case remains in a state of legal limbo.

The Georgia case is just one of several legal challenges Trump is facing. In a separate matter, he was convicted in New York in May for falsifying business records related to hush money payments made during his 2016 campaign. Additionally, Trump faces federal charges connected to his efforts to overturn the 2020 election results, although a trial date for that case has yet to be scheduled.

This case, involving 18 co-defendants including Trump’s former lawyer Rudy Giuliani and ex-White House Chief of Staff Mark Meadows, has already seen four of Trump’s associates plead guilty to lesser charges as part of plea deals.
