Finnish Authorities Explain Why Simon Ekpa Cannot Be Granted Bail

Finnish authorities have provided legal reasons why Simon Ekpa, the pro-Biafra agitator, cannot be granted bail as he remains in custody in Finland. Speaking with The Punch newspaper, Senior Detective Superintendent Mikko Laaksonen of Finland’s National Bureau of Investigation clarified that Finland’s legal system does not allow bail for suspects facing charges of the nature Ekpa is accused of.

Ekpa, alongside four others, was arrested on 21 November on allegations of involvement in terrorist activities. Finnish police have accused him of contributing to violence and crimes against civilians in southeastern Nigeria.

Legal Context and Detention

The District Court of Päijät-Häme, where the case is being heard, ruled that Ekpa should be imprisoned on “probable cause” for suspicion of public incitement to commit crimes with terrorist intent. He is expected to face trial in May 2025.

When asked about the possibility of bail, Superintendent Laaksonen explained that Finland’s legal framework does not include a bail system. Instead, suspects may face remand or travel bans depending on the case. “Our procedure is based on, depending on the case, remand or travel ban as coercive measures for limiting freedom of movement for persons suspected of offences to which such measures are applicable,” Laaksonen said.

This legal framework ensures that Ekpa remains in custody until his trial date.

Allegations Against Ekpa

Simon Ekpa is accused of financing terrorism and violating Finland’s Money Collection Act. Investigators allege that he illegally collected funds between 23 August 2021 and 18 November 2024 in Lahti, Finland. Finnish authorities also suspect that these funds were used to support activities linked to the proscribed Indigenous People of Biafra (IPOB) in Nigeria.

While IPOB advocates for an independent Biafra state carved out of southeastern and parts of southern Nigeria, the group has been associated with violent activities in the region. However, IPOB has repeatedly denied involvement in the attacks.

Following Ekpa’s arrest, IPOB’s faction loyal to its detained leader, Nnamdi Kanu, distanced itself from Ekpa. The group clarified that Ekpa was never a member of their organization.

Implications of Detention

Ekpa’s continued detention in Finland underscores the severity of the charges against him. Finnish authorities have indicated that the evidence gathered warrants strict measures to prevent his release before trial. The charges he faces, including alleged terrorism financing and incitement, are considered serious violations under Finnish and international law.

The case has drawn international attention due to its implications for Nigeria’s security and the global fight against terrorism financing. As Ekpa awaits his trial in 2025, his legal troubles highlight the complexity of addressing separatist agitations and their alleged links to criminal activities.
