Former Central Bank of Nigeria governor, Godwin Emefiele, alongside his co-defendant, Henry Isioma Omole, is set to face a fresh legal battle as the Economic and Financial Crimes Commission (EFCC) prepares to arraign them on Monday, April 8, 2024. The arraignment, slated to take place at the Ikeja State High Court in Lagos before Justice Rahman Oshodi, stems from allegations of abuse of office related to the allocation of billions of United States dollars.
The charges, totaling 26 counts, were filed by Mr. Rotimi Oyedepo (SAN) and accuse Emefiele of directing arbitrary acts in allocating foreign exchange without bids, amounting to billions of dollars between 2020 and 2023. The EFCC alleges that these actions were prejudicial to the rights of Nigerians.
Among the allegations, Emefiele is accused of allocating foreign exchange sums without bids, totaling $2,136,391,737.33, $291,945,785.59, and $1,769,254,793.16, in various instances between 2020 and 2023. Additionally, Emefiele’s co-defendant, Omole, is implicated for accepting $110,000 from Raja Punjab as a reward for Emefiele’s alleged role in favoring Raja Punjab’s employer in foreign exchange allocations.
The charges leveled against Emefiele and Omole contravene Section 73 of the Criminal Law of Lagos State, 2011. Meanwhile, President Bola Tinubu expressed gratitude to the Central Bank Investigator, Mr. Jim Obazee, for his services and officially closed the months-long investigation. Tinubu thanked Obazee for his dedication and professionalism in handling the investigation, wishing him success in future endeavors. The investigation, which concluded on March 31, 2024, has prompted follow-up actions by law enforcement and regulatory agencies.
Tinubu appointed Jim Obazee, Chief Executive Officer of the Financial Reporting Council of Nigeria, as a special investigator to probe the Central Bank of Nigeria and related entities on July 30, 2023. With the investigation closed, the legal proceedings against Emefiele and Omole are expected to unfold in the coming days, marking a significant development in Nigeria’s financial landscape.
