A Magistrate Court in Ado-Ekiti has ordered the remand of prominent Lagos-based human rights lawyer, Dele Farotimi, over allegations of defaming Aare Afe Babalola, SAN, the founder of Afe Babalola University. The case stems from claims made in Farotimi’s published book, where he allegedly accused Babalola of corrupting Nigeria’s judiciary.
Allegations of Defamation
Farotimi was arrested on Tuesday at his Lagos law chambers by officers of the Ekiti State Police Command and subsequently arraigned in court. The charges relate to his book, Nigeria and Its Criminal Justice System, where he allegedly accused Aare Afe Babalola of influencing judicial decisions at the Supreme Court. The prosecution argued that these claims exposed Babalola to public contempt, ridicule, and reputational damage.
The case against Farotimi consists of 16 counts of defamation, with the police prosecutor, Samson Osun, stating that the accusations made in the book were damaging to the renowned legal luminary’s career.
Plea and Prosecution’s Request
Farotimi pleaded not guilty to all charges during his arraignment. Prosecutor Osun requested the court to remand the defendant in custody, citing the need for thorough investigation and maintaining public order.
“This case goes beyond the individual involved. It has significant implications for maintaining the peace and stability of the nation, given the high-profile nature of the allegations,” Osun told the court.
Defense Counsel’s Argument
Farotimi’s legal counsel, Dayo Akeredolu, opposed the remand application, urging the court to grant his client bail. Akeredolu argued that the charges were bailable and emphasized Farotimi’s reputation and status as a public figure who posed no flight risk.
“The defendant is presumed innocent until proven guilty. He is a respected lawyer and human rights advocate who will not abscond or obstruct justice,” Akeredolu said, requesting bail on liberal terms or self-recognizance.
Court Ruling and Adjournment
Presiding Magistrate Abayomi Adeosun ruled in favor of the prosecution’s request, ordering Farotimi’s remand in prison custody. Adeosun emphasized that the court would ensure the matter was treated fairly and expediently.
The case has been adjourned to December 10, 2024, for further hearing.
Public Reactions
The remand of Farotimi, a well-known human rights advocate, has sparked discussions about freedom of expression and the boundaries of criticism against public figures. Supporters of Farotimi argue that his arrest undermines his right to express dissent and raises concerns about the stifling of critical voices.
On the other hand, defenders of Aare Afe Babalola assert that the allegations against him are baseless and damaging to his legacy as a respected lawyer and philanthropist.
The outcome of the case will likely draw significant public and legal attention as it unfolds.
