
In a recent legal development, Grimes, the Canadian musician and former partner of tech magnate Elon Musk, is seeking the dismissal of the parental rights lawsuit filed by Musk in the state of Texas. Grimes contends that she and their three children have relocated to California and no longer reside in the Lone Star State.
According to a report by Page Six, Grimes, in a filing made on October 6, stated that she and her two children, Tau Techno Mechanicus and Exa Dark Sideræl, both aged 1, moved to California around December 31, 2022. This assertion directly challenges Musk’s claim that the family had shared a residence in Texas from May to July of the same year.
Grimes further asserts in the court documents that Elon Musk, the co-founder of SpaceX, spends a significant amount of time on the West Coast, arguing that he is present there for two to three days each week. In contrast, she estimates that Musk, who is 52 years old, is only in Austin, Texas, where the lawsuit was filed, approximately 46 percent of the time. Grimes maintains that she has “no continuing, systematic, or minimum contacts with Texas” and believes that the court’s assumption of jurisdiction in this case is inappropriate and does not adhere to traditional notions of fair play and substantial justice.

This legal move by Grimes mirrors a similar situation involving actress Sophie Turner and musician Joe Jonas. Turner, 27, had argued that Jonas, 34, should not have filed for divorce in Florida, as they had not been full-time residents of the state for some time. The couple ultimately resolved their issues through mediation and dismissed the Florida case.
It remains uncertain how Elon Musk views Grimes’ latest motion, as neither his representatives nor his attorney have responded to Page Six’s requests for comment. Musk had previously accused Grimes of attempting to circumvent the jurisdiction of the Texas court by declaring herself a non-resident. In his filing on September 13, Musk claimed that he had provided care and control for each child since their birth, specifically in Texas, where he allegedly resides full-time.
In response to Musk’s lawsuit, Grimes filed her own parental rights lawsuit in San Francisco on September 29. In her filing, she sought a “petition to establish a parental relationship” in California and requested physical custody of their three children. She also requested a “standard restraining order” to prevent either her or Musk from relocating the children out of California.
Representatives for Grimes have not yet responded to requests for comment on her latest filing.
Grimes and Musk’s romantic relationship spanned from 2018 until their split in March 2022, shortly after the birth of their son Exa via surrogate. Their youngest child, Tau, was born after Musk had twins with Neuralink executive Shivon Zilis in November 2021. Musk and Grimes are also parents to a 3-year-old son, X AE A-XII.
